for Events of Unternehmertag AG
1. Scope
These General Terms and Conditions govern the contractual relationship between Unternehmertag AG (hereinafter referred to as the "Organiser") and participants of all events offered by the Organiser (hereinafter referred to as "Event" or "Events").
The applicable service descriptions, dates, and prices for each event are specified in the respective event announcement, invitation, or booking confirmation.
2. Registration and Conclusion of Contract
By completing the registration, the participant acknowledges the contractual conditions as binding. The participant expressly agrees to the provision of the service by the Organiser. After registration for the event, the participant will receive a registration confirmation by email. Upon issuance of the registration confirmation, the contract between the participant and the Organiser is binding for both parties. Registration is only open to holders of a valid password, which they receive via personal invitation. The password and invitation are non-transferable and intended for one-time, personal use only.
Any misuse of registration may result in cancellation.
3. Payment
Upon complete and finalized registration, the full ticket price is due for payment.
4. Additional Costs
The ticket price is generally understood as the event fee only and does not include accommodation costs. Any hotel costs for accommodation and meals must always be settled directly by the participant with the hotel.
5. Scope of Services
The scope of contractual services corresponds to the service description and price information in the invitation and on www.unternehmertag.org. Programme changes are reserved. The content of the registration confirmation is also decisive. Other agreements may be made by mutual consent. Any warranty claims remain unaffected if modified services are defective.
6. Access to the Event
Registered participants will receive a personal ID badge upon accreditation at the event venue by presenting a government-issued ID. This ID badge is intended for personal use only and is non-transferable. Access to the event is only permitted with the ID badge. Participants are required to wear the personal ID badge visibly at all times. The Organiser is entitled to check possession of the personal ID badge during the event. In case of violation of these terms, the Organiser is entitled to confiscate the ID badge at any time. The ID badge remains the property of the Organiser.
7. Companion Tickets
7.1. A maximum of one companion ticket may be booked per main participant. The companion ticket is exclusively for the spouse or life partner of the main participant.
7.2. The companion ticket only entitles access to selected event segments, specifically the Pre-Night Open Bar and the Bavarian Gaudi with Open Bar (including food and drinks, excluding breakfast). Access to masterclasses and the stage programme is not permitted with a companion ticket.
7.3. The companion ticket is personalized in the name of the spouse or life partner. A government-issued photo ID must be presented at entry to verify identity and eligibility. Transfer or assignment of the companion ticket to third parties is not permitted.
7.4. The Organiser reserves the right to cancel companion tickets for a fee if the holder is not the spouse or life partner of the main participant. In this case, the ticket price will be refunded minus a processing fee. The processing fee covers actual administrative costs and any non-refundable payment service provider fees. The amount of the processing fee will be communicated to the participant prior to refund and can be documented upon request.
8. Event Schedules and Times
The valid event schedules and times can be found in the official publications of the Organiser. Program changes are reserved, provided they are not significant and do not affect the overall character of the booked event.
9. Participant Withdrawal
If the participant withdraws, the cancellation fee is 50% of the ticket price up to 31 days before the event, and 100% of the ticket price from 30 days before the event. This also applies in cases of illness, non-attendance, or other reasons. No refund is granted for late arrival, no-show, or early departure. In case of no-show, the ticket loses its validity and cannot be transferred to another event. The ticket is personal and non-transferable. The cancellation fee will be invoiced and deducted directly from the refundable amount. Cancellation must be made in text form. If the participant withdraws from a booked transfer service, the cancellation fee is 100% from the time of booking.
10. Organiser Withdrawal
The Organiser may exercise a right of withdrawal if the scheduled execution of the event is significantly impeded, endangered, or affected by unforeseeable extraordinary circumstances, such as force majeure. If the event must be canceled due to force majeure or reasons not attributable to the Organiser, any payments already made will be fully refunded. Further claims, especially for reimbursement of travel and accommodation costs, do not exist unless the Organiser is guilty of intent or gross negligence.
If the participant persistently disrupts the event despite a warning or behaves in breach of contract, the service may be terminated and the participant expelled from the event.
11. Organiser’s Liability
The Organiser is liable without limitation for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty by the Organiser, its legal representatives, or agents. For other damages, the Organiser is only liable for intent and gross negligence. In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the typical, foreseeable damage. Further liability is excluded.
In particular, the Organiser assumes no liability for lost or stolen items unless the Organiser is guilty of intent or gross negligence.
12. Exclusion of Claims and Limitation
Notwithstanding any statutory limitation periods, participants are requested to submit any claims relating to the non-contractual performance of services in writing, as soon as possible and no later than two months after the end of the event. Statutory limitation periods remain unaffected.
13. Duty to Cooperate
The participant is obliged to do everything reasonable in the event of service disruptions to help remedy the disruption and minimize any damage. The participant is also required to immediately report any complaints to the local management, which is authorized to provide a remedy if possible. If the participant culpably fails to report a defect, the right to a reduction does not arise.
14. Image Rights
During the event, the Organiser produces photo and video recordings. This material is used for advertising purposes, in particular for documentation and presentation of the Organiser's offerings (social media, Organiser's website, press, print products). The participant should inform the photographer if they do not wish to be included in photo or video recordings. Data protection requirements are observed.
15. Data Protection
The Organiser processes the participant’s personal data necessary for the business relationship. The data required for business processing is stored confidentially and may be passed on to third parties if necessary for processing. All personal data is treated with strict confidentiality by the Organiser and any auxiliary companies. Further information can be found in the privacy policy.
16. Severability Clause
Should any provision of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The statutory provision shall apply in place of the invalid provision.
17. Jurisdiction / Applicable Law
For contracts with entrepreneurs, the place of jurisdiction is the registered office of the Organiser. For consumers, the statutory place of jurisdiction applies. The law of the event location applies unless mandatory statutory provisions oppose this.
18. Language
These General Terms and Conditions exist in German and English. In case of discrepancies between the German version and any other language version, the German version shall prevail to the extent permitted by law.
